H1 -> H4 -> H1 after the new memo

After the new BCIS memo on 3/27/2003, it seems they are more strict on pending application.

I work for company A as H1 until 12/15/2002 then lost the job, I applied H4 on 1/3/2003 still pending.

Now I found a job and they want me to come to work as soon as I can. So how can I apply a new H1 or H1 transfer with primum processing ? Do I have to cancel the pending H4 in my H1 application? What will happen if they approve H1 first then H4 or otherwise?

Urgent help please.
 
You can apply for a H4 to h1 based on the receipt of H1 to h4. Since the h1 is a change of status from the h4 (which is also pending), getting H1 approval first does not arise. Moreover It is 3months from RD of h1toh4.

So I dont think you have avenue to do premium processing for h4 to h1. My Opinion.
