H1 filling by more than one employeer?

Hello,

I am in US with L1B visa. Few US based employeer ready to process my H1B for next year. My question is: 1. Can more than one employeer apply for my H1B for the same year 2007? 2. If my H1B application is approved, shall I have to start working for the new employeer from 1st Oct 07, or can I wait for few months and then start working from say month of Dec 07 or Jan 08? (before that I will continue with my present employeer with L1B visa)

Law does not prevent multiple employers from filing H1 for you, but if both are approved, you probably won't work for one of them and it is unethical on your side in my book as one of employer threw the money to trash, and I believe you take 2 H1 seats out of quota.

If you don't want to work for H1 on Oct 1, file H1 petition without change of status.

Multiple H Employers

I came to US in October 2005 on an L1 visa with Employer A. The stamping on L1 visa expired in Jan 2006, but the petition is valid till Nov 2007. Another Employer B filed for my L1 to H1 COS in April 2006. In May 2006, Employer A too filed for my L1 to H1 COS. Employer B's COS petition was approved in August 2006 and Employer A's COS petition was approved in September 2006. I continued to work for Employer A after the COS since I required to join Employer B around January 2007. Meanwhile, Company A has been giving me salary on basis of H1 visa from October 2006. This means that I have started working for the Employer A on their H1 from October 2006. I have two paystubs after conversion and several paystubs from my L1 visa. I want to start working for Employer B from January 2007 on their approved H1 petition. I have not got stamping yet using any of the petitions. Can I start working for the Employer B from January 2007? Are there any problems in joining employer B now after having unknowingly worked on H1 from Employer A? Pl guide me as I need to take a decision. Employer B wants me to start from January 2007. Thanks in advance.

Probably you can work for B. There is unconfirmed news that if you have multiple valid H1 petitions, you can switch between these employers.
However, since there seems no official document available to public, I'd recommend to talk to lawyer as they may be able to access documents.
