H1 expiring - No GC application

Hi All,

My H1 (all 6 yrs) is expiring in early 2004 and my present
company has not started my green card yet. However,
my previous company had started the labor cert. in Apr 2001
but in a different state.
I'm wondering what my options are at the moment. Can
my H1 be extended in any way?
Or, is it possible to convert it to an L1 ?

Please advise.

Thanks.

----- If your past employer filed LC in any state for you, try to get the copy of SESA receipt that is generally sent by SESA to lawyer after LC is filed, that letter has your Case# and date when LC was filed. With that letter as Evidence of fling your LC more than 365 days you can file for 7th year extension. 7th year can be filed on the base of LC filling by ANY employer. You need the evidence from past lawyer or employer. Many SWA or SESA don’t send this receipt but if your past company lawyer or employer request they will send it. That evidence is must for you to prove that your LC was filed by XYZ .

Thanks Ginnu,

I am checking with the previous company's lawyer on that.
Meanwhile, do you know about H1- -> L1 conversion ?

Possibility, pitfalls..

Thanks a lot again.

Dear, I don’t have much experience with L1 but for L1 you have to work with company for 1 year in branch out of US and L1 has diffrent requirements than H1B and many in US Congress want L1 to be abolished, if you are qualified you can also go for O-1 check the requirements (you have to be extraordinary in your field).

Find the copy of SESA letter from lawyer that has old PD for LC and file 7th year that is easy process.
