H1 Denail & Motion to reconsider

Hi Friends,

My H1 extension application (7th year) had a RFE during Dec 2003 and INS did not like our query response and they ultimately denied the application a month ago. My lawyer now has got all the requested documents and evidences (which was requested in the RFE before denial) and already send the Motion to reopen/reconsider application to INS.

Do any of you know how the motion to reopen/reconsider procedure work? Is there any chance that now INS may reverse their denial decision and grant the H1 approval, if they are satisfied with the documents? How long this process may take?

(I know I have asked too many questions in this, but please post all you know about this).

------ do you still have H1 status?? becase if you dont have H1 status filed in 30 days(i am not sure) of denieal? it all depends how the case is argued by your lawyer

---Yes, it works if you provide eligeblity documents and your lawyer argue your case correctly
