I got my H1B stamped in Feb'08 and went to US in Apr'08 along with my husband who is also on H1B. My H1B validation is till Oct'10. But I was not placed by my employer till Aug'08 and I came back to India in Sep'08. Now my employer is saying that my H1B has been cancelled. I need some proof to know that it has been cancelled. When I check USCIS site reg. my status, it is showing as 'case pending'.
If my H1 has been cancelled, will the employer receive any cancellation form? If so what is that form called as?
Now as my husband is in US, I want to join him.
If I go for dependent stamping in India, will there be any queries reg. my H1B during stamping?
Even if my H1 is valid, can I get my H4 stamping done?
If it has been cancelled, and I got my H4 stamped and went to US, can I convert the cancelled H1B to other employer ( I dont have any paystubs)? If so, will it be activated? Or can I convert my H4 to H1B again after going to US?
