Hi:
I have a quick question regarding H-1B Visa. I am currently on a H-1B visa for Company A, and wanted to inquire if I get another H-1B visa processed through Company B(maybe transfer) while continuing working for Company A.Then if the H1-B visa transfer is approved for Company B, do I still have a choice to continue working for Company A or I am forced to work with Company B?? Can the H-1B transfer be cancelled and the old H-1B for Company A be still valid if needed??

I am asking this due to a certain instability in my current job, and just some proactive planning on my end?

thanks for your help.

similar situation.

Hi,
In fact I'm also is a very similar situation. Will be great if someone can throw some light in this matter.

Thanks.

Yes U have the choice after company B approval. However, company B visa will be difficult to stick onto after 60 days from approval date.... Some feel that the grace period after company B h1 approval is less than 60 days (30 days, 15 days...)

H-1B- Can you hold 2 of them at same time

Hi Jaxen,

thanks for your reply. I think that is good to hear. In my case I would think 60 days would be reasonable time to join company B if things remain unstable!!

thank you very much!!

that's good.

Thanks Jaxen, for the information. It surely makes one feel more comfortable to know that it is ok to interview and accept an offer and use it as a 'fall back' option because earlier my understanding was that if Company B starts H1-B transfer proceedings, then one would HAVE to quit Company A and join Company B.

Also, could you please let us know, if in the case of a merger/acquistion of Company A by another "BigFish" company, then can my Green card processing (I'm still waiting for my Labor Certification from the regional office) continue, assuming one is retained as an employee of BigFish Company.

Thanks again.

And if the job stays the same and the big fish is ready to pursue GC you should be fine.
