H1 B visa denied under 221(g) - any interview tips

Hi
I have been in US for the past 3.5 years as an B1, then an F1 and most recently on an H1 approved petition.
My application for H1 has been denied by the american consulate at delhi
under section 221(g) - incomplete documentation.
The docs that they specified as must haves had already been provided.
Now they are asking for additional documents about the company.
If anyone else can share his / her similar experiences that will be very useful

Do they know they are destroying your career at Delhi Consulate? This is not right. If you have never been out of status then why this rejection?
Would u pls provide some more details?

One more question..

Did you change your status after coming in on B1? And after F1 you contined H1 job rather than go for stamping? Is this right? I am in the same boat and would like to know if the consulate brought this point as a basis for rejection?

I\'m still awating call from the embassy

My visa had been denied 6 months back under 221(g). No extra documents were asked but no reason had been stated. Still have no clue
why my visa is being with held. My original hiB is with the consulate.
 
I was also in the same boat in 2000

My visa was also rejected under section 221g at Delhi Consulate. But I was given visa after 4 months. Provide them company tax statements, photographs, My experience in India was also checked, and I use to go to the embassy every fifteen days. They take their own sweet time, but they provide visa sooner or later.

Details:
Got B1 in 1998
no out of status - went to india
got F1 without any interview
again no out of status
got H1 petition approved in December 2000
Now they have sent 221(g)
 
Can you provide more details of your case

Had you travelled to US earlier or
did you ever go out of status
I had not provided original degree certificate - they returned my originals before filing
 
it has happened to my spouse, but got stamping later

My spouse went for H1 stamping in Chennai consulate in 97 Feb, with visa. This was the first time, no other previous B1s or F1s. They asked for additional docs, same 221(g) rejection. My spouse visited again with those papers in Apr \'97. Again they said the papers were not sufficient. Finally in Jul 97 the stamping was given.

The company sponsoring for the H1 was a new one and it seems my spouse was the first one to go for stamping. The consulate advised my spouse, to consider some other company. But we kept attempting with the same company\'s H1. And it did work.

They were interested in tax papers, taxes filed in US by the company. It is not a rejection and you can keep visiting them with the additional documents until they are satisfied. Make sure you are providing them what they require. Like the second time that company gave us papers (tax), filed here in India, they have a subsidary here in India. But the consulate was interested in seeing tax papers filed in US. So we had to visit a 3rd time.

do they ask questions or do I just give the required documents to them

Visa stampimg at st.loius

Hi ,

I am in a kind of similar situation...My visa stamping was temporarily refused for revalidation at st.Louis and they asked me to go to madras for stamping. I was never out of status after landing in US(all along in H1B since 1999)...do you think its worth to get it stamped in madras ? Please let me know.

well dunno at present

I came for to India on a vacation a few days ago.
Haven\'t been to the interview yet
They have asked for w2 for all the employees of the company.

It may be useful for you to take a lot (and that means a lot) of company information. Details of it are present on the chennai consulate\'s website
 
web appointment / letter appointment

so the refusal letter that I have says that I have to present myself at the consulate on any day (Mon - Thur) between 12 - 12:30
does this consitute an appointment or do I have to take a formal appointment via the web
any advice appreciated
 
That is an appointmnet bros...

Plus There was a guy by the name of Arun Mathur he too is in the same boadt applying from Madras. I wish he can share some info...

Can the Senator help us revalidating our H1 Visas ?
This is new to me....Can someone put more light on it ?

well usually the last resort is senator - a letter from him clears up a lot of issues - that\'s what I have read on attorneys advisin in newsgroup

A few questions that may help to throw up any patterns(though I am a bit skeptical)
a)Which consulate was the visa refused?
b)Was this the first time that the applicant was travelling to US?
c)If not, was the applicant out of status at any time in US?
d)Is the employer publicly listed or venture funded? Any acquisitions?
e)Do they ask for only the documents in the visa interview?
f)Do they take time to go through all the company docs(eg. they have asked for W2 forms for all the employees)

My answers
a) new delhi
b) no - have travelled five times
c) no
d) public listed - acquisitions yes
e) and f) to be answered by someone more experienced
please add to the list of questions
