Hi All,

I have a question about H1-B extension after 6 years of H1-B. Here's my situation:

H1-B expire date: 12/15/2010 (original start date was 12/14/2004, so six years completed)
Green card status: PERM still pending
Employer filed for I-129 request for extension.

But Employer requested for extension until 12/15/2013. He probably should have requested only until 12/15/2011.

USCIS issued approval until 12/15/2013.

I have the following questions:

1. Since I am eligible for only a 1-year extension (since my PERM is pending), but USCIS issued a 3-year extension (either because the employer requested so, or for reasons I don't know), should I need to contact the USCIS now and let them know that I am eligible for only 1-year and not 3-years extension?

2. Should I tell them that my employer should have put 12/15/2011 and NOT 12/15/2013 in the I-129 application?

3. If I go to India for visa stamping in 2 months, will I have any problems?

Please let me know if anyone had this experience

Thanks

Better get it amended. USCIS is not responsible for this three years extn by mistake. This is you or your company attorney responsibilty to get it corrected even if USCIS make a mistake.
