Hi All,
I have a question about H1-B extension after 6 years of H1-B. Here's my situation:
H1-B expire date: 12/15/2010 (original start date was 12/14/2004, so six years completed)
Green card status: PERM still pending
Employer filed for I-129 request for extension.
But Employer requested for extension until 12/15/2013. He probably should have requested only until 12/15/2011.
USCIS issued approval until 12/15/2013.
I have the following questions:
1. Since I am eligible for only a 1-year extension (since my PERM is pending), but USCIS issued a 3-year extension (either because the employer requested so, or for reasons I don't know), should I need to contact the USCIS now and let them know that I am eligible for only 1-year and not 3-years extension?
2. Should I tell them that my employer should have put 12/15/2011 and NOT 12/15/2013 in the I-129 application?
3. If I go to India for visa stamping in 2 months, will I have any problems?
