h1 b 6th year and job change

Hi experts,

Need a word of advice, I am going to start 6th year from May 2006. My company has applied for 7th year extension (may 2007-may2008) based on LC filed in Mar 2005.

So once the extension is approved i will have 2 years on my H1 from May (2006-2008).

1. Can i change my job now and file a new LC with new company and then get 8th year extension? Or my 7th year extension is only valid with my present company?

2. Any risks of doing this?

Appreciate any pointers.

Do H-1B transfer. Then you can have your H-1B extended year by year as long as you have an LC filed one year ago.

How is it possible to file extension that start date is more than 6 months ahead ?
 
My attorneys are updating my H1 with my new title, so they are going to request extension simultaneously, it seems it is possible.

I read your original post again, and figured it is possible.

YOu can move, but if current employer revoked LC after you moved, you will be in trouble.

But why would i be in trouble if my present company revoked LC. Since the 7th year extemsion would already be approved.And in any case since i am still to go into 6th year i can file a new LC in the next company...

Does the 7th year extension become inactive once the original LC filed gets withdrawn?

That rule is not clearly stated in memo as long as I know. Some lawyer says it's still valid even after LC is revoked, some says it's not valid.
 
Ok here is my situation

My present company who has filed my LC 1 yr ago. Has extended my H1B for the 7th year, valid till July 2008, now if i move since my 6th year starts from july 2006, my new company is willing to go ahead and file LC by July so it wil lbe on the border of my 6th year starts...

1. If all goes well and i get my I-140 in the next 12 months i am set.
2. If my I-140 stage is not reached by 12 months , then i may or may not get my 7th year valid as my present LC might have got revoked, and the newl LC wud not be valid for 12 365 days.

How much is the risk I am taking, worst case if i anticipate things i can go out of country for 1-2 months and recapture some days to show 365 LC pending days...

What would u do if you were me...go for the next job or stay back and sob on the immigration saga.

H1b and physicians

Dear Experts

I'm not sure if this is the correct forum - but will try anyway, because it is kind of related. I am a physician from UK, doing research on H1b since 2002, planning to apply for a 6 year residency program to start in 2007. I am concerned that the residency programs will not be able to even consider me for a 6 year contract, since I will have already had 5 years of a 6 year H1b. Is my only option to return to my country for 1 year and reapply?

My husband has filed for GC through his employer, using an internet service (recommended by his firm) which we have found to be very unhelpful (read: useless). His PD was April 2002 and only last month did he receive the 45 day letter, his application is now handled by Dallas Backlog center. We also found out that he is EB3, despite the fact that his job requires a PhD. We are now going to file through an attorney using the PERM route, trying to keep the same PD. I understand the best case scenario, for myself to get a GC or labor cert as the spouse, will take at least 12 months.

Any advice would be appreciated.

Hi Guys, Need some advice:
I am in 5th year H1. LC approved by PERM in Feb 06.

1.I now have a good offer from a very big company. If I transfer my H1, can I get 2 year extention along with the transfer? What will be needed for this considering my current employer does not revoke my current LC.

2.When should my new employer file for LC? My H1 is till sep 07 (6 years) If i get extn, should I still file for LC with in Sep 06?

I will appriciate any help.
