H1 and H4 simultaneous filing

Hi Jaxen/All other Friends,

Suppose if a person is on H1 and currently his H1 transfer is in process, what if he applies for H4 because of some reasons ?

1 .Can he continue to work after he applies for H4 as he is having H1.

2. What if H4 comes first and H1 later?

I appreciate for the reply.
 
Hi

In true world your status will change as of INS system changes.
as you know it takes 10 to 20 days to receive any notice through up to you
Actaully H4 to H1 will be consider as new H1.
But depends on date of filling,you can be considered as H1 tranfer also,I think you can work on H1 receipt.

Dates are like this,

Applied for H1-B transfer in October'2002 in CA, not yer recieved the H1-b approval.

Because of some reasons, Iam planning to appply for H4 visa. What happens if I apply for H4 before the H1 comes ? Can I still work even after the H4 reciept comes as my current visa is valid till Oct 2003.

But I want to apply for H4 for some reasons.

Yes technically you can work until you receive notification from INS from h4. Talk to a lawyer if you are not confident about sharing the dates and paystub info...
