H1 7th year extension

Please respond:

I am completing my 6th year of H1 in a couple of months. A company A filed for my GC labor around 2 years back (well before my 5th year on H1 ended). I work for a company B (which holds my H1 now) and want to switch to company C. Can I get my H1-B transferred to company C (7th year H1) based on the pending labor with company A.

Thanks

---------------------YES, and for extension you need the evidence that LC for you is pending more than 365 days
Thanks

Thanks

So this H1 transfer and extension can happen at the same time so that I get valid H1 with company C until 2008. My 6th year ends early 2007. BTW, yes my labor was filed more than 365 days before with Company A. Please let me know.

Also, My current company B applied for my PERM which got approved before my 5th year ended. Company A's 140 is pending, however I don't want to wait till 140 gets approved as I am not too hopeful about that. My question is if I should use this PERM labor or the pending labor with company A to get the H1-B transfer/7th year extension with company C. And if I decide to go with PERM do I have to mention that 140 is pending on that ? And if I have to do that, what happens if 140 gets denied while my H1 transfer/extension is pending.

Thanks again
