H1 7th Year extension & GC

HI
1) My H1B 6 years limit expires on Apr 08/2004, Labor applied in IL state (on or around Aug 15/2003), now its for Federal processing on Dec31/2003. I have 10+2 weeks (two intervals) of out of stay frm USA, can I get extension for these days? could any body of you explain me what are the chances that I can be on Legal status???

2) USCIS says the H1B cap already reached as of Feb 17/04, but says that we can file for H1B from Apr 1 for 2005 quota. So if we file my wife H1B on Apr 1 can she be on status and what will be my status.

3) Could you please tell us the different options that me and my wife can be on legal status independently (my status without effecting her status and vice-versa).

How can I extend the H-1 beyond the 6 year time frame with the amount of time spent in INDIA??
