My daughter is getting married in October'2011 to a man who is working in USA on a H1 visa.
I want to know the exact procedure we should follow so that my daughter can go back to the USA with her husband immediately after the marriage.Her husband will be in India for two weeks after the weddding

1 After marriage your daughter will need marriage certificate from Registrar of marriage office.

2 After marriage if she has her passport with surname Duggal or Dugal then she should get new passport copy with her married Last name or married Surname and her husband name should be on her new passport copy. Any agent sitting near Passport office can help her getting new passport. You know that " Chai Pani" works in Indian System
3 Make sure that her husband is on Valid H1 status in US and is being paid by employer. Your daughter can get H4 visa if spouse is on H1 valid status. FYI at this time many H1 Visa stamps or H4 visa stamps are being rejected as the embassy or US consulates asks truckload of documents from US employer.
4 once she has her marriage certificate then she will need H1 approval Notice of her husband, Copy of his pay stubs of last 6-7 months, Copy of his W-2 for last 3 years, Copy of his passport (she will show only what is asked by Consulate or embassy). She will apply for H4 Visa through VFS and you can check the US embassy site for Nonimmigrant visa info.
4. If she comes to US on H4 she cannot work on H4 visa status in US... Find out if his employer has filed Green Card for him or not. If employer has just started His Green Card process then it may take 7-9 years to get Green Card

** as the person will be only for two weeks in India it does not seem to be possible that your daughter will go with him to US because Visa stamping will take time.

Thanks for your input.Why should she change her passport,Surname etc.All her documents including all Educational certificates/Bank Accounts/IT Returns etc are in the present name/Surname.If she goes to the Embassy alongwith her Husband,with required appointment,Registered Marriage certificate,Photographs of Marriage,Invitation Cards from both sides,all releveant documents of Husbands H1B status,payslips etc,themn why cant stamping be done immediately.

---US has no problem if she keeps her Surname as DUGGAL or DUGAL after marriage.
Her last name will not Match with her husband last name. Did your wife still use her Maiden name? is not your wife surname Dugal? most of the ladies in India after marriage change the last name/surname and use the last name/surname of husband

*** I think you earlier Posted that Mundda "Boy" will be for 2 weeks in India. Once the marriage is performed in Gurudwara/Mandir or at home then your daughter and her husband both have to apply for the marriage certificate and sign the forms. I dont thibk they can get Certificate in one day.(may be possible if you are ready to givbe Bribe to Babbu).After she gets marriage cetificate in hand then she is going to fill up the form and pay the Fees to VFS and one cant get Visa appointment through VFS in 4-5 days. I know you are from Delhi and Delhi is most corrupt city in India and one can get many papers/documents made in 1-2 days but US Embassy does not work like Delhi Political system. for more info you can visit the embassy or VFS.

My wife still uses her maidan name in her passport and not surname Dugal.Am I right to assume in that case, my daughter doesnt need to change her name and Passport immediately.She can ofcouse do it later if she so desires.
Yes Mundda"Boy" will be in India for two weeks,but my daughter will apply through VFS in advance for an appointment, maybe 4-5 days after the Wedding, which will be solemnised in a Gurdwara.Within those 4-5 days we will get the Marriage certificate,without giving any bribe but by using my Goodwill, after which the couple can go together to the Embassy on the date of the appointment, for the H4 stamping alongwith all documents,photographs,Marriage Certificate etc.
Do you think I am assuming right or do I need to think of another course.

--But wife of Kartar Singh Duggal uses her name as Ayesha Duggal.

---------------- US does not care of wife uses her maiden name or married name. FYI they know that ladies in India change the name after marriage and use the last name/surname of husband after marriage. FYI Bombay US consulate need that Ladies should get husband name endorsed in her passport. Later if her Derivative GC is filed with her husband and then she changes her name that create problems. My suggestion is to change it NOW or not to change in future. She should ask this question to her husband or she has to decide. I don't think you should decide for your daughters future name after marriage. Kudi nu apnay hon valay pati naal gal karni chahidi hai te jis trahan una nu changa lagey karna chahida hai. ------- I think She can only apply AFTER she gets Marriage certificate. VFS will ask on what basis she is applying H4 visa? where is the evidence that she is Spouse of H1 holder? where is marriage certificate? Talk to VFS.
