H-4 Extension - Urgent Advice

I'm in end of sixth year and I-140 has been applied for. My I-94 & my wife's I-94(she is in H-4) are expiring by 2nd week of Oct-09.
My H-1 Extension has been applied for. My employer says he has to wait for my H-1 approval in order to apply for my wife's H-4 extension. He also mentioned that she will be in status as long as my H-1 extension is applied for. However I want to clarify will there be any issues in my wife's legal stay? Do we need to apply for H-4 extension before her I-94 expires?
Please advice asap

----------why you did not file her H4 extension with form I-539 with your H1 extension papers? if H4 extension is filed with H1 extension in same envelope then both get approved on same date and both get same I-94 expiry date.
My employer says he has to wait for my H-1 approval in order to apply for my wife's H-4 extension.

--------------------Yes, Yes, Yes. file her H4 extension ASAP with your H1 filing reciept copy and on cover letter mention that H1 Ext for primary is filed. dont talk to your employer he is giving you wrong info and go to lawyer and your wife H4 extension Must reach USCIS Before her I-94 gets expired.

Unfortunately I dont have access to the lawyer directly I have to go thro my employer channel only. I'll try to get the H-4 extension filed asap

We are in the same boat as my husband's employer filed his extension and got it done and suggested the same as your employer.

My H4 visa which is going to expire in march,10. My husband got his H1 extension for next 3 yrs.

Is it fine enough if i go to canda with my husband and get my visa stamped along with him or do i need to file a separate extension n then get it done.

Or do i need to go back to my home country India and then get it done in the same way as i hve done for the first time of H4 stamping.

please give me your valuable suggestions or share your experiences as we are not finding out the way to manage it.

If the H4 visa stamping gets rejected in Canada Or Mexico then one has to go directly to home country for Visa stamping from Canada Or Mexico .
