My current H-1B visa on the passport is valid till april 2004 and am currently in queue for I-485. If i wish to travel to India within the next few months, is it possible to come back to the States with the Visa alone? Or do i need to get AP? Some please reply back.

If you are working for company with a valid H1 and have a valid H1 visa stamped in your passport, you CAN travel on H1 even though you are in AOS pending status.

However, it is advisable to have AP also as security concerns are more now than before.

Good Luck!

Anyone recently traveled on H-1B w/o AP?

Thanks Upstate. However, i wish to know if anyone has traveled recently without AP but with valid H-1B without a problem. Do let me know.

There were plenty of such cases in :

ImmigrationPortal Forums > ImmigrationPortal.com > US Immigration > Immigrant Visas (Green Cards) > I-485 Issues > 485 issues in Vermont Service Center

You may want to search there or whichever Service Center you have filed 485.

My husband and I recently went to India on h-1b. Our 485s are pending and AP was approved, although we did not have our AP approval notices with us when we travelled because we did not receive them yet. We have no problems with immigration. Hopefully you won't too.
