H-1B revalidation question

Hi Guys,

I am preparing the documents to revalidate my H-1B visa. My first H-1B is expiring January/01/2004, my I-94 will expire the same day. Right now my lawyer is filing my H-1B extension through the premium process. I expect to receive my new I-797 form next month. But at the time I mail out my application for H-1B revalidation, probibally my I-94 already expired, I am wondering if that matters. I heard If the Form I-94 has expired, I should submit a valid Form I-797 Notice of Approval from the USCIS for revalidation. I am not sure what is a "I-797 Notice of Approval ", is that just the regular I-797 form?

Any info is helpful, thank you very much.

---- that is correct, once you get the H1b approval(I-797) that you may get next month then send the passport with H1 approval notice foe Visa revalidation, don’t mail the PP now

----- Approval notice from BCIS
