Hi ALL

Would anyone guide me by his/her experience of h-1B refusal?

Actually I was refused my H-1B at US COnsulate,ISLAMABAD,PAKISTAN.
Visa officer didnt tell me any pre-defined reason oif refusal. He just raised an objection that he assumed that I might have got job with help of one of my friends whose name I did mention in DS-156 I had plans to live with while being in USA.
He also didnt give me back my I797B form (H-1b Approval).Kept all forms (Ds-156/157/158) and H1b Appreoval letter copy which was sent to me by employer.
Now what if I want to re-apply,do i need that original copy?
Though I have photocopies of it,but someone told me to get that original one back from EMBASSY.Now would anyone guide me how to get that back?

Would embassy give me that back?

Regards

This is a blunder, you should have put your employer address.

Hi Great Guru,

I have mentioned the contact of our immigration specialist, but have put a very well known Hotel address that is near to my office location as the Address that I will stay in the US.

Do you think that could pose a similar problem for me too? Our company generally provides temporary hotel accomodation to its employees at that hotel and as I really would be staying there the initial few weeks, I have mentioned the hotels address.

Thanks.

Unfortunately, I have already sent the DS156 form. :(
Honestly, I don't think its REQUIRED to put your employer's address.

I presume you are talking about Q. 24 on DS-156
"At What Address Will You Stay in The U.S.?"

Makes no sense to put employer's address -- after all you are going to work for that employer - not live at that place (unless its one of those bodyshoppers !! :) ).

I think mentioning that hotel address is O.K -- you really are going to stay there ... I mean for all that you care, you may elect to stay in a hotel for 6 yrs -- why should that be a problem !!

Don't worry too much

Yeah, that sounds right. Rather, feels right. :) Secondly, in one of the questions, that requests specific travel plans -- I had none when I filled out the form and so I wrote NONE.

However, when asked an approximate date by which I would like to arrive in the US, I have given an approximate date because the question says 'intend' to arrive (approx dates are also asked for).

Currently, I have blocked air tickets and hence can say that I have a specific travel plans. Wouldn't that kind of contradict my answer to the question? I think, if asked, It would be best to clarify that my intenerary had been fixed after I had sent in the material and although now, I have a booking the arrival date was then an approximation. I do have my travel itenerary to show to them, if the need be.

Do you guys think that is OK? Any suggestions on the matter?

Sorry to hear about your case. You did the right thing to put the place where you were going to stay which was the truth. You never want to lie on these applications. It makes no sense to reject a visa on "where you are going to stay" whether it is with a friend or family.

What kind of job did you get aproval on? Did the officer tell you how to proceed with this? You need to get your foot back into the embassy. Try to send a photocopy of all documents and get another interview.
