Greetings,

My current H-1B LCA mentions my place of work as NJ.
My current client is based in NJ. As such, i'm working and staying in NJ.

My employer has a branch in Texas and he is executing my payroll from Texas for which there are no State taxes he is deducting from my payroll.

However, on my paystubs and W2, the addess mentioned is of my current NJ state. My employer has filed my green card from Illinios. I had completed Labor Certification and I-140 process.

My question is:

Is it legal that my employer is running the payroll from Texas even though i'm working in NJ. My H-1B LCA states that my place of work is NJ.

Thanks,

I believe (and I may be wrong) your employer can run payroll from any of its offices where it has presence. As far as you are concerned, the only thing you need to worry about is to ensure that you pay the state of NJ all the state income tax you owe. I assume your employer is not withholding any NJ income tax from your your pay cycles.
