H-1B extension questions.

Hello Guys,

Happy new year to you all!

I have some questions regarding the H-1B extension. My current H-1B will expire in 6 months. I will need to travel to my home country for a company project from Feb.-Apr . My questions are below:

1. Can I leave US after I submit my extension application? What would happen if the USCIS knows I am in overseas?

2. How long will it take to get the extension application approval? Can I go through the premium process for it?

3. My I-485 is pending. Does this have any negative impacts if I apply for extension in my home country?

1. Nothing happens.
2. You can run premium process.
3. No impact. BUT if I485 got approved when you were abroad, it might be complicated unless you have AP.

Thanks. When I mentioned to our HR that I might travel to my home country, HR said if so I have to go to American Embassy in my home country to get the approval. So should I tell HR or not tell HR that I will travel overseas? Any advice?

Your H1 visa stamp will expires within 6 months, is that correct ?
And your projected reentry date to the US is within H1 stamp validity, it that right ?
If so, you can enter the US. It was 2 years ago, but I entered the US with H1 stamp which would expire in a month.

Ask HR WHY you need new stamp when you have valid stamp.

I don't have H-1 visa stamp on my passport. I entered America on F-1 at the first time and my employer filed H-1B while I was on OPT. Dose anyone know about "Consular Notification"? Anyone has experence on this?
