I am a canadian citizen, born in india, working in the US. Currently I am on a H-1B 9 (completing the 3 yr term, and renewal for next 3 yrs in process) as the company started the GC process, but was stuck at the PERM stage. Initially i was on a TN-1 prior to the H-1B.
Right now i am evaluating options to switch jobs, and one offer requires me to switch back to TN-1 due to the cost involved for them in transferring the H-1 B and they do not want to commit to a GC right now. Something they might consider in the future.
Is this a do-able thing meaning switch from H-1 back to TN-1. I understand to re-do GC, i will have to go back on H-1 again. Also if do-able do I have to go back to CANADA for the switch, or can it be done will being here in the US, like i did for TN-1 renewal and converting to H-1 B.
Any feedback is highly appreciated.
