My H-1B application was submitted last Dec, long after the july 2006 cap was reached. Does this application have hope? USCIS has written asking formore info. I wonder why we weren't told to re-apply by Apr 1. Does this mean a non-proft organization that employs special ed teachers qualify under the no-quota case, or is this just false hope on my part? I got my masters her ein the US. Pls. advice.

If you are going to work for a non-profit org like a special Educational School, you will get your H1 after submitting required information.
You are not subject to any cap.

Thanks, Guru for your reply. Accdg to our HR Manager, we don't have an acknowledgment receipt no. yet. He said Homeland Security asked for more money because the application fee was wrong so he sent more. Isn't it since there's no acknowledgment no., no processing was done yet? Also, our HR manager didn't submit an LCA which I think is required for all even special ed teachers, am I correct here? I told him he can do the LCA online. He has applied for my H-1B to take effect May 8, 2007. Do we have enough time? Also, if we submitted it for regular processing can I still request that it be premium processing and pay more if it is taking them a long time?
Going back to the special education sector, I want to be certain if the quota doesn't apply to it. My employer is non-profit but it is not a research institution and it is not affiliated with higher education. I teach Grades 3-11 only in a special ed school hospital setting, severe disabilities sector.

Unless you have teacher credential and obtain teacher license no one is going to sponser you.
