Hi

I was laid off last Friday and received an offer from another company today. My previous employer informed the INS of the decision last friday itself.

I have not informed the new employer of this change. My question is...

Should I still try for an H-1 transfer with the new company? I have heard of cases of up to when the INS has treated it as a transfer even when the previous H-1 expired a month back. I will be dealing with the Vermont Service Center.

Thanks.

You should immediately file H1 transfer; lawyer can complete the paperwork in one day and send H1transfer application to service center. You can also use the premium processing by paying $1000 extra will get H1 transfer in 15 days

Thanks Ginnu -

The new offer is from a large firm and the bureaucracy will take its time. Most probably the lawyers will file by beginning of next week. Is that a problem?

Keep your fingers crossed. Nobody knows how BCIS will react... But a week should not be a big issue...

Nobody knows how the letter was composed and how does BCIS react to H1 termination. ie. does the letter say, cancle H1 on so and so date or it just states that the H1 should be cancelled.
Which date BCIS will use......who knows.

But if yr new company files by next week, you should be ok (hope....yr fingers are crossed).
