Guys .. Shed some Light

Please advise..

Guys,

I applied for I-140 in Feb, 2004 and my I-485 in March, 2004 in EB2 category. I noticed today only that the A#'s listed on my I-140 and I-485 are different. But the A#s that I have on AP, EAD and I-485 are the same. The questions I have are -
1. Would it be a problem if we have different A#s on I-140 and I-485?
2. In case I need to get it corrected, what is the procedure.

Anybody has similar scenario. My 140 RFE was responded on SEP 15th and there were some LUD's for 4-5 days and nothing happened. All of the sudden my 140, 485 & spouse 485 has an LUD yesterday, what does this mean. It looks unusal to me. Please let me know, if you have experienced anything similar.

Infact I was typing up a PM for you regarding this.

No Updates on either of our EAD. Both of our EAD was approved earlier and we did not apply for our AP.

Just to refresh your memory. I had 3 RFE's (just one notification).

1. Education
USCIS has stated that I have only 3 years degree and asked for an evaluation. I actually had 4 years engineering degree and my attorney did a re-evaluation and they said, it should not be a problem.

2. My W2.
My attorney mentioned she has included all my W2 since my priority date.

3. Ability to pay
There were multiple RFE's in my company for ability to pay and they have received 3 approvals after responding to RFE. My employer has mentioned that, there should not be any problem and all our case has to be approved and its just matter of time. I have no other choice other than to trust him.

But my concern grew today,as I saw LUD's on my 140, mine and my spouse 485. No updates on my EAD and there was no change in message. So wondering is it for a good cause or a bad one. I think, its you who have mentioned earlier that, if the case is denied , the status message will not be updated and they just mail the notice. So, I am very worried. Let me know. Please share your experience too.

Hang tight for the next couple of days. BTW, did your colleagues also get their 485's approved after 140 got approved?

I heard one of them got their 485 approved, but not sure if he has done his FP earlier or not. I haven't done my FP yet.

Also, there was one employee who got an RFE for ability to pay , which was responded and he again got another rfe after a month for experience letter.

Already after sending my RFE response, it was a nightmare. Now, after this LUD, I am kinda totally lost. As you said, just need to wait and see. I wish, my application just gets approved without any more problems.

UN, one more question, when your application(s) were denied, was there any status change or just an acknowledgement that, your RFE response was received?

I hope in my case, my application's got updated for some good reason. But anyway, I can't conventrate on anything else.

Do not worry on this update. I have gone thru same kind of LUD's like yours.

In my case, RFE response was received on 6/23, updates to 140 about 7 times within 10 days and 485 once for me and wife.

Again updates to 140 and 485 both on 7/27 and 7/28 for me and wife. No change on the child's 485 anytime. There has been no update after that.

I talked to immigration officer last week and checked about status and if there was any problem with the case.

She told me that from whatever she could see, the case was going normal, pending approal.

I also asked why no action on 140 yet, She said it was under processing. On FP notice, she told me that I should be getting it anytime now.

It is now almost 2.5 months and both 485 / 140 are pending. It is very frustrating wait but one has to just live with it till resolved.

Wow..That's a long wait. Thanks for sharing the info with me, I wish you get your 140 & 485 approval soon. Also wondering,

1.Did you speak with Customer Service or Immigration officer ?
2.Did you initiate a status inquiry since your RFE response was recieved more than 60 days?
3. Any updates on ur or wife's EAD / AP?
4. What is the RFE about? (Guide me to your thread, if you have posted already)
5. When did you apply for 140 & 485?
6. Was it a concurrent or catchup concurrent?

Ans - Yes, I talked to immigration officer, customer service rep forwarded me to immigration officer.

Ans- -Yes, I have initiated one last week.

Ans - Nope, no update there

4. What is the RFE about? (Guide me to your thread, if you have posted already)

Ans - RFE was never received but the website updated automatically in less than a week from the date of RFE. I sent a lot of papers to USCIS on my own, which were received by them before the LUD changes happened.

5. When did you apply for 140 & 485?

Ans - ND is 7/11/2003

6. Was it a concurrent or catchup concurrent?

Ans - Concurrent.

My case was withdrawn by the employer before 140 approval but almost 250 days after ND. I have used AC21 to counter that. The case is still open after 7 months of withdrawl sent by the employer and I got 140 copy couple of weeks back using FOIA, which still shows 140 pending and blank action block. The immigration officer also confirmed it was pending like a usual case. On saying that I have used AC21, she said it does not matter after 180 days. She was not able to confirm anything more on the status except that it was pending. Only time will tell if I would get it approved or not. I am keeping my fingers crossed.

Guys,

I just checked my Portfolio and guess what, 140, 485 for me and spouse got updated again today. Just don't know, what the hell is happening. This pain and frustration is really killing me (most of us).

I am in a similar situation.

USCIS received response to RFE (Ability to pay) on Sept 17th, 2004. The LUD is Sept 22, 2004. No change after that. No change in message.

What does that mean? Would it help to talk to customer service and find out if it is pending approval / denial?

Thats normal. Wait for couple of more weeks.
 
Just an update, my applications were updated yesterday and there is no change in the status message yet. I spoke with few of my contacts and was told that, its normal and nothing to worry about it. But anyway, I could not help myself from worrying as this is stopping me from taking some decisions related to "Life Events". I just can't believe how this GC is affecting our life style. Keep me posted with your versions, atleast talking our relieves the tension a bit.

I would say don't postpone Marriage or Conceiving a Baby etc., because of this :D . My 140 response to the "ability to pay" RFE is not acknowledged at all, and it's over 7 weeks since we submitted. And today my attorney called them to find out that my case was randomly transfered to a diff. officer since they sent the RFE and that guy didn't updated the website. Can you expect anything worst than that? And they told they received all the response papers and will let us know soo.....n. :confused:

So Take it easy..
