My Attorney received my I-140 approval notice. Approval notices did not talk about 'appellate body review'. so I am happy for now and looking at next step to be approved :)

Congratulations!!. Does it mean that, your 140 status message never updated to reflect that "140 has been approved"?

Nothing to my knowledge UN. But, I spoke with my company and they said, there were total 5 approvals so far (Remember, we had totally 7 RFE's for ability to pay) and they are expecting mine either this week or following week. Lets hope everything goes fine.

At this point, I have some hope for 2 reasons
1.Cases responded before me are getting approved
2. If its Denial or negative impact, probably attorney or employer should have heard by now , as my LUD happened on 13th Oct.

What do you think?

Yes, I think if it was negative your company would have heard by now. Maybe it is taking your case a little longer because in your RFE they also asked about education evaluation.

No, I haven't done my FP yet. True, I had a RFE with Education too, but it was straight forward. CIS believed, I had only 3 years of College Education, but infact I had 4 years of college education. So, I thought it was a staright forward one, but you never know.

Hi,

I had an RFE on I-140 and USCIS received it on 9/17. The LUD is 9/22 and nothing after that. No change is message / status.

I have fingerprinting scheduled on 11/02.

What does concurrent approval mean? Does it mean after FP, I-140 will get approved?

Should I keep waiting for I-140 or will it help to talk to cust service or someone?

Please advice!!!!!

Most probably, it could be a concurrent approval. Also, I believe, they will not issue FP notice unless ur 140 is ready to be approved or approved already. All the best and keep us posted

Kishore, I hope your words are true. But I thought FP is a separate process and is not dependent on the I-140. Is that true?

Also, since my LUD on I-140 was 9/17, if it were to be denied, should the lawyer have heard by now?

I do not believe they are doing concurrent approvals. If some one got it, that must be luck.
I had almost similar situation (See signature below), and they approved 140 day before getting fingerprinting results.

Don't lose hope, your 485 can still get approved, as we can see lot of people for their 485 approved as soon as FP is received. I agree with you that, there is big play of luck in the approvals, but Don't lose your hope.

My 140 is still pending, all I am doing is just hoping, as I can't do anything else. :-)

My wife (Primary applicant) and I got fingerprinted on Nov 2.

I-140 RFE (Ability to pay) was received by USCIS on 9/17 and LUD was 9/22

But today I checked and the LUD on 1-140 and I-485 (on my wife's) are 11/04. But no change in status message.

Is this good new or bad news?????? Please advice.

I believe its a good news. Did your ststaus message changed to "FP Received...blah blah" in either your 485 or your wife's 485.....

I was watching couple of cases, similar to yours & mine(Just that, I haven't FP'ed yet) and they got 485 & 140 approved concurrently. Also, there are many cases where 140 alone got approved. Don't lose hope and keep your fingers crossed

No, Kishore. Status message on both I-485 is the same as the original message - "Your application for I-485 was received....."

You bet my fingers are crossed.

What's happenning with your case? Any more LUDs?

Nothing is happening with my case. LUD on all my cases are 10/13/04 and there is no chnage in status message. This is killing me.

Got RFE received message on 9th September and updated 4 days in a row and then on 27th received approved message with 'appellate body review'. but i seen a copy of my i-140. it does not talk anything about appellate body review and just normal i-140 approval notice
 
Update

Kishore, UN, Others...

Wife (Primary applicant) had RFE ON I-140. Online message says "Response to Rfe received on Sept 17....."

Both got fingerprinted on Nov 2.

The LUD on my wife's I-140, I-485 and my I-485 got updated to 11/05.

Online message only changed for my I-485 - "Fingeprinting results received and processing is resumed....."

No message change for wife's I-140 / I-485 but LUD updated to same date as my I-485.

What to make of this?
