My wife got her I-140 approved some time ago and we received the notification from the National Visa Center.

We have already filed for Adjustment of Status based on my I-140 approval.

Will the NVC approval (my wifes I-140 petition) expire if we dont act on it? If so will the NVC give us notice before the cancel the approval?

Thanks

Is this the package 3 you are talking about?

By applying for 485 you have acted on it. If this is the CP package you are talking about then all you need to do is send a letter to NVC saying that you are going for Adjustment of status with ...service center and not going for consular processing.

I think Bandra was talking about something else.

He and his wife each got an I-140 approval and they filed AOS based on his. I don\'t think you need to file another I-485. But if you could try CP on her I-140, you got 2 options - I remeber seeing this

I-140 does not expire

As far as I know, once approved, I-140 remains valid indefinitely. I read about it in several discussion boards and in some of the attorneys\' web sites. I myself filed my I-485, more than one year after my I-140 was approved.
