Hi Guys,
Today is my last day with the company. They are terminating me. I have valid H1 until August 25th 2005. I am 7th year extension. If I apply my 8th year H1 from different company on Tuesday or Wednesday will it be a problem? As my company already terminated my H1? Oh my I dont want my enemy also in my situation. My 140 (RFE) & 485 are pending. Status is not an issue as of now. But thinking of H1. I am pretty sure we will apply Tuesday or Wednesday. But One or Two days after Termination will it create a problem.

1 or 2 days definitely will not create any problem to you. Who hold your LC/I 140 to get H1 transfered to 8th year. If it is the same company terminate you hold the LC/I140, they may withdraw the petition. You may loose all of your status.

Hi Great Guru,
My company is NOT going to withdraw anything right now. They offered me a job in India and wants to contiue the process. The same company which holds my H1 and LC/140. The same company terminated me. I am looking for another company who can tranfer my 8th year H1. My previous company wont withdraw my application. I am pretty sure. Now Can I transfer H1 for 8th year?
I have EAD with me but 140 is pending with RFE and crossed 180 days. I can use AC21 but if 140 is denied then I will be out of status. So want to be here on H1 for next year with new company.

if you are sure about it, go ahead with 8th yr extn of H1 with new company.
