I just got married and my husband is a GC holder and is going to get citizen ship in 2009. I am currently having H1 status and the period of 6 years will get over in May 2008. Please guide me what best thing to do now. SHould i wait for my husband to get the citizenship then apply for GC or should i apply from my current company for GC. THanks in advance. Please guide me

if you have a choice of doing both employment based GC and marriage based GC, it never hurts to do both.

Your husband should file I-130 for you anyway.

I cannot see any benefits to having the husband file an FB2A I-130.

The proper thing to do is have the company file an LC so that she is eventually eligible for a 7th-year H. Once the husband becomes a citizen he should file an I-130/I-485.

aahh, here is the catch. Some people get an administrative check that lasts for years, others - too many speeding tickets, DUI, vehicular manslaughter, something that may prevent him from getting his citizenship in a couple of years. That's where an approved I-130 and a current PD comes in handy. It has happened before.
