Hello,

I have a question about the recruiting process. My company put ads out there and they got a couple of candidates that meet the minimum requirements. They were interviewed and they are still interested in the job.

1. Is there anything we can do to disqualify them?? We tried saying that there are no benefits, no bonuses and other things to discuarage them and still nothing.

2. Is there anything that can be done? Can we give any other lawful reason to disqulify them?

3. If not, how long do we have to wait to start recruitment again, 30, 60 days?

4. Can we use the same ads, or do we have to put new ones?

Very bad luck.

Wait for 90 Days. (no rule but you have to cool-down the situation)

You have to start new advt. This time very careful about job title and its description and select unpopular news paper but approved by DOL.
Here job description is very very important.

My job title is Computer and Information Systems Manager. The ad was very simple. We said we require MS in Info systems or equivalent plus 2 years experience in job OR Bachelor in Information Systems plus 5 years experience in job. That's it. We did not put any other things in it other then of course the company name and where to send your resumes. I guess the idea was to have not too tight so DOL would not question it. Should we rewrite the ad and if so, what should it say? Thank you again for taking your time.
 
Hi puzon23,

open ajb.org (america's job bank) and see how other PERM ads with similar job titles look like. PERM ads have very specific language and are easy to spot. Look for sentences like "experience can be pre or post degree", "Masters or equivalent in ..." "5 years progressive experience". That will give you an idea how to make the ad both general and specific enough. Good luck!
 
Info system Manager title not an aggressive technica/hard core coding job where many locals shy away. Analyst/Sr Programmer with specific program language skill set will not attract many locals.

You're right about that but my job does not require any programming. It is a position for a IT department managing. It would be hard for my company to justify the title when there is no need for a programing whatsoever. Besides, I want it to be an EB2 case. EB2 ROW is current and I fall in that category with Computer Systems manager title.
 
Sr System Analyst / Programmer also fall into that category OR DBA for your ofce database.

Yes if you want to stick on to your old title, you have already three locals available for your positions, so you will not get your PERM or greencard.
