Got RFE fro parent's CP.....Please help!

Hi,

I had submitted froms DS230 for my parents in India. Today I got emails for submitting the following:

1) Father's birth certificate
2) Petitioner documents-- previous marriage certificate

For 1)....I had submitted NABC,Affidavit signed by my grandmother,my father's school certificates stating his date of birth.
Since I already submitted all of these as his C is not available,why would I get an RFE for the same documents?

For 2).....I had called NVC before sending documents as I (Petitioner) do not have my previous marriage certificate as it was in India and we did not even register the marriage and I waas told to write a letter explaining why marriage certificate is not available.And I wrote and attached the letter with petitions and to be on safe side,also my original divorce decree.

What else,if anything,can I do now? I did call NVC again explaining everything and they said they'll review the documents again. I am so stressed now .

1. The non-availability of certificate is required from the registrar's office where your parent was born (if the original birth certificate cannot be obtained). On village/town letter head it should be mentioned that 'We do not have the birth record of Mr. X son of Mr.Y' and officer's signature and stamp is required. This is required in addition to the affidavit for birth confirmation of your dad with 2 elderly people's signature,their address,relationship,address etc.
2. may be an affidavit should help for this.

I understand your situation and how you are going. I am on same boat and my father also does not have birth certificate. So I got non-availability of certificate from my father born village from Talati. and also two affidavits from elderly people. So not sure it will work or not based on what you have experience.

I am also in almost same situation. I did get RFE after I sent DS230 & other stuff. I send my parents birth cert with affidavits. I called last week & NVC told me that they are waiting for Passport clearance for my mom's case which is also holding my dad's case (dad's case is complete as told by NVC). I had sent the passport clearance with DS230 in dec 2012 & now they assigned my case to supervisor's review which is going to take another 3 weeks.
I am not sure whether I should sent photocopy of passport clearance which i have with me here in US or I should ask my parents to get another original from passport office then send to me or I should wait for supervisor's review??????

What is passport clearance ? Is it same as Police clearnace Certificate we need to get from passport office ?

How did you get passport clearance ?

I think you should wait for supervisor review. They don't honor photocopies anyways. I sent the same documents for my mom but did not get RFE for her and for my dad I did! Don't know what goes on in their minds when they check papers. Hope for best and wait. Let us know when they get back to you.
 
Passport clearance is the paper issued by local passport offices in India saying that they don't have any objection with the person's identity.

You are right...they are skipping papers irresponsibly & adding time/harassment..Sure I will let you know when I get any update..

Update - I called NVC yesterday & they said they need more time to review (10-15 working days) but they do accept photocopy of passport clearance. I am going to send it today.
 
I called yesterday NVC to find out if they need police clearance and passport clearance certificate for my father in IV package. NVC mention that it is not require for NVC but my father has to carry during interview.

My father will go Mumbai consulate.

Sukhi : Are you parent will go Mumbai ?

Is there a time limit within which you have to reply to the RFE? It doesn't say anywhere in the email but I'm just worried. Since I spoke to NVC I'm still waiting for supervisor review.
 
I don't think so there is any time frame to reply for RFE but one must have to contact NVC within one year :)
 
Update:
I got email with the interview letters for my parents. Interview date is 8th march :)

I sent last paperwork in dec 2012, delivered on 31st dec 2012. So exactly 1 month after they received last paperwork.

Hello There!

I am a US Citizen currently married and I also petitioned both of my parents who are actually both here.

I have a question, why did they asked you for your previous marriage certificate?

I never sent my marriage certificate since I believe my marriage has nothing to do with my parent's petition.

Any ideas or suggestions?
