Dear all,
I filed my application last month and now got a job offer...I knew officially I cannot work without the new EAD card.

I really want to get the offer and are willing to do the volunteer without pays first. I heard that it should be OK as long as it is a non-profit organization?

Wondering if anyone has similar situation before or can give me some advice..

Thanks for the help!!!!

Technically you can not anything for free that someone else would get paid for...because per USCIS law even if they don't pay you but woulld have paid someone else for the same job you are performing...if the volunteer position is w/o pay irrespective of who does it (aka they can prove so with historic evidence) then I believe you can volunteer your time.

If they normally would pay somebody to work in that position, you can't volunteer for the position without employment authorization. Ask them to delay your start date.

Jackolantern,

I thought illegal work is forgiven if one is married to a USC? Please clarify.

Firstly, unauthorized employment is overlooked, not forgiven, there is a difference.
Secondly, that does not protect the employer for hiring someone without work authorisation. DHS can still fine the employer. Would an employer take that risk?

Illegal work is forgiven when one marries a USC.
