Hello Experts,
My brother got a B1/B2 visa( 10 years) for a conference in LA on April 15-20.

Question is can he directly come to atlanta on 22 April without going to conference LA?Offcourse he has a return ticket after 5 months.

Does port of entry immigration has his details like You got VISA for a conference in LA and why you going to atlanta etc?

Thanks for reading my question, Please advice me?

He will be asked the purpose of visit at entry; if he says conference at LA
it's safer to land at LA.

I live in Atlanta, If My brother says: i am visiting my brother in Atlanta and going to leave in 5 months (Has a return ticket) , is it OK?

He is comming after conference date, Does Officer know that my brother got stamped because of that conference invitation in LA?

OK. this is from personal experiences and I have been through this several times. Going through the Port of Entry and stating that you plan to stay in US for whole 5 months and live with brother; immediately, this shoots a huge warning sign to the immigration officer. I know this is the truth but he will have tons of questions to prepare for (what does he do for a living, how much he makes a year, how does he plans to pay for his 5 months here in US, etc). On the other hand, return tickets are not relevant once he mentions he plans to stay for more than a normal visitor (i.e. 2 weeks - 4 weeks for vacation). In a nutshell, he will not have an easy port of entry experience. Good luck to your brother.

Thanks banano1842,

Ok , if my brother says i am visiting my brother for 1-2 months and have return ticket after 5 months is make sense,

Please suggest me the best way.

1) Go to LA and attend 1 week meeting and back to Atlanta by local flight.
2)Come to Atlanta directly and tell them 1 month vacation to visit brother.
3) Do you guys know, usually for how many days he get I 94 validity (6 months).

To whom you are going to tell. There is no body asking you other than security check in the air port. You can go freely with in US with proper Photo ID3) Do you guys know, usually for how many days he get I 94 validity (6 months). It depends on the interview at the port of entry. if he says going for conferenc for one or two weeks , usually he may be issued I 94 for 1 or 2 months

Thanks GURU,

Second point is :

Actual question is: If my brother comes to Atlanta from india without going to LA,
At port of entry, can my brother say " i came to visit my brother in atlanta for 1-2 months and return ticket has after 5 months" is that fair answer?

Please suggest me.

My suggestion

Here's my personal advice...

He should come to Atlanta and answer as follows:

What is the purpose of your visit?
Business and leisure... I plan to attend a Conference about yatayatayata (not mention city unless immigration officer asks). Afterwards, will have some fun just getting to know the big city, there's lots to do here.

What do you do for a living?
I am a student (have proof of being a student), I work (have proof of place you work), I just graduated and will enjoy some time off.

How long are you planning to stay in the US?
(give this answer in days) about 45 days... this makes the immigration officer do the math and he'll most likely stamp I-94 for 6 months.

How will you pay for your trip & expenses here?
Credit card, and show the credit while you are answering.

My recommendation is to give short answers and only answer what officer asks, and avoid giving any words that can lead more questioning and even a denial of entry, or a short term I-94. On more thing is to have your brother make an actual reservation at any hotel in Atlanta (e.g. in buckhead or downtown), and have him write this Hotel Name/Address in the I-94.

Hope everything goes well...

If your brother stated on the visa application that he needed to visit the US for a business conference and he instead chooses to visit purely for social reasons then that would most likely be construed as a fraudulent application surely. Why doesn't your brother attend the conference and then visit you?
