Hello to All,

I am new here, so please be light on me :)

Sometime Jul. 2003 Company A laid me off, and I quickly got an offer from Company B, and they let me started working mid of Aug. 2003 on the basis of Immigration lawyers advise that the LC for me has started, is the lawyer correct on this basis?

Then we got an RFE from USCIS asking for my recent paystubs from Company A. If the lawyer is wrong in enterpreting the rule of portability. Is gonna be grounds for denial of h1b transfer? Did it mess up my status?

What could my chance on this one?

You cannot work on the basis of LCA filing.
Do you have a letter/document from lawyer about 'it is okay to work f'or new company? Your company will also be affected now. So they need to do some blame game.

My guess is that yes, it did mess up your status...
 
Thank you Jaxen... Now I am worried this thing puts my family in joepardy...

Is there any way out on my situation? Is it grounds for denial of transfer?
