01/26/2005: Good News for Visa Movement

AILA has reported the DOS advised AILA that "thanks? to" the decrease in demand for EB visa numbers from USCIS I-485 cases and 245(i) labor cases still being held in the Department of Labor, the visa number would progress forward as follows:
Worldwide EB-1 and EB-2: There will be no cut-off date for the these categories.
Worldwide EB-3: Unlike the DOS previous prediction that the large number of 245(i) filings would be filed during March and April 2001 and it would result in a surge of EB-3 number demand and would limit movement of the cut-off date, 245(i) cases still remain at the DOL and therefore there will be movement in EB-3 visa numbers.
India EB-1 and EB-2: It will continue a rapid movement for the next several months.
India EB-3: It will move ahead but may become limited down the road.
China EB-1 and EB-2: It will continue a rapid movement for the next several months.
China EB-3: It will stay at the Worldwide date.
What a good news!

Let's wait and see.

But atleast they are giving us some feedback and cheers.
Others don't seem to care as much.

I like there other news about GC's issued to different countries in FY 2005 and
their stake in the comprehensive reform bill.
 
Spoke with a lawyer

I spoke with a lawyer very briefly and he said not to worry and that the visa will become available soon. Didn't give any details. Take it for what it's worth.
 
Department of State has advised AILA DOS Liaison Chair Liam Schwartz that it has seen a decrease in demand for employment-based visa numbers for USCIS adjustment of status cases. This has resulted in the rapid advancement of the established cut-off dates. DOS does not want to be in a position where there are large amounts of numbers available for use late in the fiscal year, and not enough time to make use of them. But, when/if the USCIS demand does materialize it may be necessary to hold or retrogress (at some point) those dates. Below are DOS' comments on the outlook for employment-based numbers:

"Worldwide: Based on the current level of number use in the Employment First and Second preference categories there will be no need to impose a cut-off date for the categories. While the First preference number use is relatively close to my target, the Second preference is significantly below my target which doesn't make a lot of sense.

Third: I had been concerned that the amount of 245(i) filings during March/April 2001 would result in a large concentration of demand, and limit movement of the cut-off date. So far this has not been the case, and it may be that such cases (if they exist in large numbers) are still in the DOL backlog.

China and India: The same lack of demand comments apply to these First and Second preference cut-offs. This has resulted in the rapid advancement of the China and India cut-offs, which I expect to continue for the next several months.

China Third - Should stay at the Worldwide date.

India - This cut-off should continue to move, but such movement may become more limited. "

It would just be a temporary reprieve. Those 245i labors have to get approved eventually.

Therefore, eb3 may mover forward temporarily and then move way backwards again.
The point is you could file I485 & EAD once PD moves forward. No matter if it moves back, you have gotten what you need.
 
exactly all we need as of now is be able to file for i-485 and get an ead.hope some new bill will be approved in senate next month which allows us to do so.
oh god or not what are we doing here away from home and loved ones.inida as of now economy is booming,if things dont change better to go back to home country.

So what is the impact on the EB3 waite time. Seems taht EB3 VISAS will not improve.

Get married

Guys guys guys,
The best way to get the Green Card is to either get married or go to Mexico and come in as an illegal immigrant. One might ask how am I going to cross the border, the answer is easy...The Mexican government will provide you with the maps of safe crossing points and places to get fresh cold water...I'm not finished yet, there are busses waiting for your arival and will transfer you to major cirties to get a job and at the end of the day if you stay in US for couple of years you'll qualify for Green Card.
Here is the quickest way to get married, you go to a low class bar and hit on the fattttest girl you find, just tell her that she is beautiful and you'll get your GC in two yrs

DOL received over 106,000 new regular permanent labor certifications nationally. In addition, over 235,000 245 (i) labor certifications were received prior to the April 30, 2001 deadline.


so that 235 000 and 106000 ,,I think to be pessimist,,half of them cleared till now or filed 485,,
so...remaining 140 000 ..it seems that world will go to 2002 till october..
give your idea please

Can understand the frustration! but nothing can solve the problem so easily. Let us wait for the good.

Yeah but then you are stuck with the big fat girl or the big fat alimony. Also if you cross you have a job alright but you would be lucky if they pay minimum wage, a recent survey of illegals showed that about half reported instances of not even getting paid sometimes. It always looks rosy on the other side.

What your lawyer meant was:please don't get disappointed and go back. I appreciate you annual contributions in the form of EAD/AP/H1 renewals.
