what about name check???

based on recent approvals -- name check may have become non-issue. FP done on 5 May 04 has resulted in approval on June 23rd. Have they stream lined security check process?

I believe, security clearance wasn't that bad earlier - it took less than 2 months. The important change is Fujie memo. However, not many pending 140 have their FP done. They should start issueing FP notices soon to continue the trend.

I think going by the wave theory proposed by ETA-GC, if the first wave of 485 approvals finds that the 140 is not approved yet, (since this case was not approved in the first two wave’s and is waiting for the third wave) then there is more likelihood that both get approved concurrently. I hate speculating, but looking at some of the approvals this is what it seems like.

I think it is always minimum of 2 waves. Like we saw for 485 - one in 2002(random) and one in early 2003. For 140 - one in Jan-Jul 2003, second in Oct-Nov 2003. For concurrent - this seems to be first wave - where will second wave start from?

I think the first wave of 140 approvals is in Nov-Dec, second wave from June - Oct and the third wave early 2003 ( Jan - May) to clear the backlog 140 cases. The first wave of 485's is in early 2003, second mid to late 2002 and third wave early 2002. I feel that in order to clear the backlog, 485 wave will start approving the applications concurrently if 140 for some reason has not been approved yet. 140 applications will continue to be approved before 485 till 140 current date passes April 30 2004 after which the memo may be implemented. After that we might see all the applications approved/processed concurrently. This gives VSC sufficient time to clear the backlog 485 cases and the first wave of 485 approvals catching up to be around late 2003. If your 140 has not been approved yet and you are in the third wave of 140 approvals, then you might be lucky to find both you 140 and 485 approved concurrently. We should be able to ascertain what VSC is doing by observing their approval pattern in the next couple of months. (Fully aware that VSC never likes to follow any pattern and defy all odds )

It's a good thing as long as your current job is stable and if they really do process the I-485 (and I-140) fairly quickly.

I'm personally glad to have my I-140, even if I have to wait longer for the I-485 as I don't intend to change fields and, if necessary, I can AC-21 to a different location / company now.

I am waiting for my I-140 such that I can try for another job and my wife can use EAD. Eventhough she can use EAD now but I dont want to take risk by using it before my 140 is approved ( sub labor ) because then she has to go to India and come back on H4.
