Going to School on EAD/AP

Someone please advise....

I am currently on EAD/Advanced Parole and waiting for adjustment of Status to Permanent Residency through my wife's application via her employer.

I am planning to go back to School fulltime in the Fall. In the event that I have not yet received my green Card at that point, will I need an F-1 visa to go back to school full-time, or is an EAD/AP sufficient?

Pending I-485 is sufficient for school,even EAD is not necessary to got school. EAD is required if you want to work along with school.
 
Contact the school where seeking admission.

Hi rsr112,
When your wife working in a comapny and on H1B visa, May be you are on H4 visa. With H4 visa you can join in school and study. But as a full-time student, your H-4 will be good enough(EAD doen't matter). contact International Student Advisor/Office in the School where you are seeking admission and explain them ASAP. It is time for Admission letters and assistantshipsm for Fall 2004. On H4 visa you are eligible for scholarships only not for assistantships. For Assistantships you need full-time student status(varies from school to school). My wife joined in H4 and applied for status change to F-1. In 14 days got approval last year fall. Let me know If you need any help. I was full-time student here for 4 years.

Hi Sree234,

Some schools consider EAD from employment based applications as a pending green card initial approval document and apply instate /US resident fees. Some schools apply the above condition + the length of your stay as 1 or 2 years in that state will qualify you for in-state tution(that is what GC holders and US citizens will pay). Coming to F-1 status will qualify your wife to get Assistantships( to work for ar easerch professor or as teaching assistant) or work for 20 hours per week in campus. May be eligible for Marit based Scholarships too( unusual in Computer science/ EEE/Mech/Environmental etc. the common immigrants desciplines). With EAD also all these possible, but she will lose her H4 status by using EAD. Coming to F-1 will become independent from your status. When applying for her status change, she must justify the status change(why) and yours and/or her immigration status must support your reason for status change (remeber that. most cases failed to jusify were rejected, as far as I know). Make a decision based on when She is planning to go to school.

If she has an EAD based on a pending adjustment, there is a 99.9% chance that a change to F1 would be rejected for immigrant intent. Even if not, she would also need to prove a foreign residence, be subject to SEVIS registration and possibly be subject to taxation in her home country.

No one in their right mind should shift to F-1 if they can avoid it.
