Going to Canada... Coming back to US

Hi,

My H1 visa expires FEB 2008 and company will send me to a branch office in Canada until the company gets me back to US with a different visa - I don't know if this is possible but my boss is trying to find out the type of the visa. He heard from his boss who heard from the lawyer : (

Question 1:
Anyone got an idea what kind of visa (other than H1 after 1 year outside US) can bring me in?

Question 2:
Can't the company sponsor GC anytime no matter when my visa expires or no matter I am here in US or Canada, can it? I am trying to ask company to initiate GC process RIGHT NOW regardless the fact that I have to leave the country before FEB 2008.

Just heard from my boss and the company is going to pursue an L-1 visa.
It says the visa allows foreign workers to relocate to the corporates US office after having worked abroad for the company for at least one year prior to being granted L-1 status. It looks like I have to stay over there for a year.

My next question is:

if the company files for a GC now, how soon can I come back to US?
After I-140? or I-485?

You can not file I485 when you are residing in foreign country. You have to either come back before I485 filing or just go through consular process.
