Going Canda and Coming Back

Hi,

I was on F-1 visa and recently got a job. My H-1 has been approved and I have it with me. I am also a permanent resindent in Canada. I want to go to canada to take care of some paperworks. I do have the I-94 from my student visa which continue through my H-1 as I never left USA after I took up the job. My questions are:

1. can I travel to Canada and enter back to USA using my I-94 from H-1 approval.

2. When i enter back to USA, will it be a problem if immigration ask me to show my H-1 visa in my passport.

3. Do i Have double protection in entering back having a canadian resindetship and previous I-94 which is still valid (i GUESS)?

1. yes if your travel back is within 30 days of departure
2. No, I94 is enough. So either do not give the I94 while going out or make a certified copy of h1 I94 before going out of US.
3. There is nothing like double protection. The only protection is the H1 I94.
 
Did you have your H1 stamp ? If you don't then I think its a good idea to have it done then trying to come back with your student I-94. After Sept.11th I would be circumspective about not giving up your I-94. Also when you try to come back as Canadian Resident, you might not be able to convince the officer of your intent. Some people did have problems trying to come back with that perspective, including myself.

I don't have the H1 stamp on my passport. That's why I am somehow skeptical about the whole thing. But it seems as long as you have a valid I-94 nad H1B approval with you and it is less than 30 days, it should not be problem. can you please what is your visa status and hat problem you exactly faced. I am nto going to comeback as canadian rather i will try showing my H1B approval and I-94 from my previous entry.

I think I am pretty sure that if you are intending to come back as a H1,, you have to get your passport stamped. Then you have to go to the consulate/embassy to get it done. Check with your Lawer...
