hi! Gurus,

I am working on EAD, with AC21 case, I am thinking to play safe and work on H1 and let I-485 progress on its own..Incase of rejection I dont have to pack up. This is basically my idea.

Is it possible to go back to H1B (H1 transfer) without abondoning 485?

Thanks,
-Rama

I dont think doing an h1 will abandon 485. However your old h1 should not have expired for you to use it.

Jaxen, I changed company

Thanks Jaxen,

For response, I filed for 485 when my company A laid off and filed for chapter 11. I filed for 485 and did H1b transfer for company B then again after terminated used EAD to find similar job as joined on EAD at company C.

Can I go back and transfer H1 from company B to C??
Do I have to go out of US and get passport stamped??

Pl. comment,
-Rama

I beleive, once you use EAD, You cannot do H1 xfer anymore. You have to apply for a fresh H1, in case you need one, and are subject to the annual cap for H1(on the fresh H1 applied).

If you have started to work for company C using EAD(and not doing a h1 transfer), then you have to do a new H1.
