Completely incorrect. USCIS is forbidden from denying an I-485 for an Immediate Relative because of an overstay.
This was actually a problem I could've faced (if not that I can still face)... I completed my studies (F-1) the month after I got married, february... then... the journey started (see timeline), from what I know the 4 months I lost because of my lawyer add up in "overstay", which means 8(august, date of real submission of the I485) - 2 (february, date in which i terminated my studies) = 6 months - 2 (period of stay allowed by INS after termination of studies) = 4 months of overstaying my visa... from what I understood... everything still goes smooth until you don't overstay 180days after your visa expiration... or not?
