Hi everyone,
Plz help me with this ... My husband has filed for his H1-b.. currently on OPT n myself on F2. But i m planning to visit my parents in India but i have so many questions...
1) Can i apply for H4 along with my husband H1 application, wat r the charges and when will we get the stamped receipt of approval?
2) IF i travel to India while my H4 petition is still in processing, can i re-enter US on my F2?
3) In case i go to India with my current visa status, will i have to get my status changed in India, n if yes, are there ne chances of my application being accepted or rejected?
4)Will i have to go through the interview all over again?
5) My son was born here in US on Jan 1st 2004, so can my application be rejected or approved considering this point?

{{You can apply for H4 along with his H1.
Fee for filing H4 is $195.00.
Approval (decision) time depends on which Center you are filing at.You will not get stamped receipt of approval.You will receive only an approval notice.
Next time you visit India, you can get your passport stamped at an appropriate US Consulate in India.}}

{{If you leave US after filing H4 but before a decision on it has been made, it will be deemed that the petition has been abandoned.

You can enter on F2 if you currently have the F2 visa stamped in your passport and if your related I-94 is still valid.In this case, however, if your arrival date in the US is very close to the I-94 expiry date, you may have potential problem at the Port of Entry.

If you do not have your current F2 stamped in your passport, then you will have to apply for the same at the Us consulate in India.}}

{{If you are going to India on your current F2, then it is your choice if you want to return on your current F2 (read in conjunction with the above answer) or on H4.If you plan to return on H4, then you will have to wait in India till your husband's H1 is approved in the US and he receives the approval notice,on the basis of which you will have to apply at the proper US Consulate in India for your H4.Once it is approved, you can return on H-4.

If you have maintained legal status throughout your stay in the US, not resorted to fraud, no criminal records, etc,then normally you should not have any problem in having your H4 approved in India. }}

I have some concerns regarding my F2 visa.....

1) My husband has graduated and is currently on his OPT duration in US. His OPT expires on May31st 2005. His I-94 as well as my I-94 has a stamp which says D/S (duration of study) as the expiration date.
Now if i plan to travel to India on my F2 can I return back on F2 before May 31st 2005? Will the OPT expiration date be considered as the I94 expiration date for both of us? If that is so I think I can travel to India and return back on F2. (If not please correct me).

2) In case my husband's does a premium processing for his H1-b and at the same time even I apply for my H4 petition (H4 cannot apply for premium processing), will my husband's H1 and my H4 approval notice come at the same time?

{{Yes, you can return on your F2 but not too close to May 31st,05.

31st May 2005 will be the I-94 expiry date unless your husband's H1B and your H4 get approved prior to that,inwhich case, you will receive a new expiry date.

You have not mentioned if you have the current F2 visa stamped in your passport.If it is not stamped, then you would need to attend interview in India and get your PP stamped with the F2 before you can return on it.}}

{{If you apply for H4 in the SAME envelope together with his H1 petition under premium processing, then chances are both of them will get approved together,though no guarantee.

If your H4 does not get approved together with his H1, one option is, after his H1 approval notice is received, withdraw your H4, travel to India, apply for H4 at Indian consulate and then return on your new H4.}}
