Getting married to a US Citizen whose already "married" in her home country.

I need some help trying to figure out this dilemma my friend seemingly has. Apparently, in India, his girlfriend who is a US citizen, married her brother; in order for the brother to obtain his visa. The brother was denied visa because some years before, the girl's family previously tried to bring the brother to the US and stated that he was a family member on the visa app. The officers at the Consulate recognized this new attempt and rejected his new app. Now, the question remains, is his girlfriend still married to her brother (I believe they went through some legal marital ritual in India and obtain certificates) If so, what would my friend and his girlfriend have to do in order for them to get married now? If not, then it would be as if his girlfriend never married at all and my friend could then legally get married to her without any problems? Thanks! Any feedback would greatly help.
 
Let me get this straight. Your friend's girlfriend legally married her own brother???

You answered your own question. Your friends dumb girlfriend has to divorce her brother before being eligible to marry and sponsor him. If they went through some legal marital ritual and obtained certificates what do you think it is but a marriage.

Even after she divorces her brother, the chances are your friend is going to have serious problems adjusting status through marriage to her not only because it will take 5 years before she can sponsor someone else but because she is a fraud and will rightfully be viewed very suspiciously and will get stonewalled as much as possible by USCIS.

Indeed I strongly recommend your friend not marry such an unscrupulous person. There are many fish to fry in the sea. Hopefully that friend is not yourself.
