Getting divorce before 10-year GC

I got married on Aug/8/2008. It's almost our anniversary and my husband is not even looking forward to it. I found out last night that he has been seeing a new girl and they actually slept together twice. I knew something was up with him but never thought in a million year that he would cheat. He's the nicest, kindest person. The new girl is actually his best friend's girlfriend. The husband I know would never do this kind of things. I'm so disappointed in him. I cried my heart out last night. Our marriage doesn't even last a year.

Anyway, I have a question about this. My husband is actually willing to help me out by staying married until I get my green card. But really, I want a divorce. Although I know it's pretty risky at this point since I was living in a dorm (still a college student). I do have proofs of plane tickets of him and me flying back and forth. He also paid for all of my tuition using his credit card and we were planning to move into our apartment together. We already had a contract signing by him. Everything was under his name. He was taking a real good care of me. I was out of country for a month and when I came back, he's changed. Although I saw it coming as he was getting really close to the girl. Always picking her up from work and talking to her about business they wanna start. I fought with him over that girl before, but I didn't think he'd actually fall for her since she's his best friend's girlfriend.

Anyway, what do you guys think?
If I do get divorce now and file for a waiver, how is my chance for a 10-year GC?
 
As far as I know, if you still have a conditional green card and divorce, when your green card expire, you will no longer be a resident. Sorry about your situation but either you stay with your husband until two years is up or you divorce and become non-resident after the green card expires
 
That is incorrect. As soon as the divorce is finalised, the OP should file an I-751 to have her conditions lifted.

As far as I know, if you still have a conditional green card and divorce, when your green card expire, you will no longer be a resident.
 
What happens to the green card status in case of a divorce before the two year period ? Can he/she still work legally ?
