GC/Visa for Fiancee

Hi,

I am a Green Card holder working in US. I am getting married next year but my fiancée is in India and she does not hold any valid US visa.

  • What are the best possible ways of me to call her to US before or after the marriage next year?
  • I read it somewhere if you apply GC for spouse it take around 4-5yrs? In that case how can I call her to US in the time the GC application is processed.

Any time of help will be really appreciated.

1) The ONLY thing you can do is file I-130 and she has to wait until her Priority Date becomes current.

2) You can "call her" all you want... by telephone... :rolleyes:... She has to wait 4-5 years for the priority date to become current, plus 1 year for processing.

If she qualifies, she could opt for a H1B or L1 visa... or perhaps even a F1 visa, but she must maintain her visa status... once you file I-130, it will be a lot harder to prove "non-immigrant" intent.
 
I got my GC in 2005 but after that I took 2 years extension for completing my studies in India. I came back to US in Dec 2007 and in US since then..
 
Do I need to explicitly apply for the citizenship or once I am eligible in 2011 then I have to apply for it.
