i got denied the H1-B visa in December and my lawyer told me i had 6 months to live the country. so at what point did i became out of status? am i considered illegal here now?

my boyfriend and i got married recently and we filling out the I130, on the form it asks for expiration of I-94 but i only got D/S on my card but i am not sure about the duration of my status, what should it be?

I don't mean to sound like a jerk, but why didn't you ask these questions to your lawyer?

The reason I say that, is because you might be in a sticky situation and shouldn't rely on the answers from people here alone.

Are you in the US or overseas? You mentioned your visa got denied. Are you sure it is your visa and not COS from some non-immigrant visa to H-1B? Seeing your I-94 says "D/S", were you on F-1 by any chance and your COS to H-1B got denied? If you are in the US and you marry your boyfriend and file for AOS, then your overstay will be forgiven.

if your boyfriend is a US citizen, of course. And as long as you don't leave the States until you have your GC.
