Hi all!

I want to ask two questions:
1) how long it usually takes to get GC (if possible split time by steps: LC,...) from Massachusetts.
2) if i start LC with one employer do I need to start it again with other when I change my job?

Will appreciate any help.

LC (PERM) : 4 to 6 months (Including preparing, recruiting & process)
I-140 : 6 to 8 months
I-485 : 8 to 12 months

I-140 & I-485 can be filed togather if PD if current in your category (Currently PD is current in EB-2. For EB-3 PD cutoff is June-2002) In case of PD retrogression you will have to wait for PD to pass your LC filling date before you can file for I-485

2) if i start LC with one employer do I need to start it again with other when I change my job?

if you change job duing LC or I-140 & your employer withdraws the GC process you have to refile all over again. You are allowed to change job after 180 days of I-485 filing date

Will appreciate any help.

Since EB2 is current, does this pretty much mean that one would get their EAD and is eligible to switch jobs in about 10 months? (4 months for PERM, then if I140 and I485 is filed simultaneously, in 6 months they would get their EAD?)

I am a newbie. What does this mean?

" In case of PD retrogression you will have to wait for PD to pass your LC filling date before you can file for I-485 "

YES, If EB-2 is current when you are ready to file I-140/485 then you can get EAD in couple of months & eligible to change jobs after 6 months of I-485 filing date.

Say you filed LC on August 2002 (that will be your PD : Priority Date). & Currently EB-3 has retrogressed to June-02 (only people with PD June-02 & earlier can file I-485). So in this case you will be waiting for PD Cutoff to move to August-2002 before you can file I-485.

So, retrogession affects only 485 and not the 140 stage? I can apply for 140 even if its not current?

Well ..

1. I joined my current job as an entry level candidate with a Masters degree. Now i have two years experience. Am i eligible for EB-2 under PERM? Do i also need to be in a Managerial position or something like that?

2. Lets say i change job after 180 days of filing 485. In such a case, can my current employer withdraw my GC process? What negative could i have if he withdraws?

3. How can i find out if "EB-2 is current" or not for Texas Service Center? Should i be looking at the dates of 140 or 485?

4. Is there "PD retrogression " for EB-2 as well?

Thanks in advance,

1. maybe - depends on business necessity I would say.
2. You can - they can do nothing. You might have to write a letter to CIS invoking AC-21 and maybe answer an RFE, but it is totally possible (as long as new job is in 'same or similar'....)
3. It is not dependent on service center. www.travel.state.gov tells you what categories are current. For service center processing times see www.uscis.gov
4. not yet

Is there anything serious if company withdraws I-140 ?

Not if it is after the 180 days of I-485 pending. I mean that's specifically why AC-21 was created - so that their possible withdrawing doesn't affect you. I suggest you find the latest Yates memo from 5/12/05 for ex. on shusterman.com and read it yourself - it will definitely be clear then.
