GC Sponsor with no tracable income/ Co-Sponsor?

Hi,

I am currently holding L1B status that is good for another year. I want to get married to my boyfriend. I know that the sponsor has to proove that he will be able to take care of me finacially. My boyfriend has never been on payroll and also never filed a tax return. He can show an employment letter but thats it. Can he still file for a GC for me?

I heard that there is a possiblilty to have a second person sponsor me as well. Is that true?

Has anybody been in a similar situation? Any suggestions?

Why hasn't he ever filed a tax return if he was employed? Without a good reason (such as, is income didn't meet the threshold) that sounds very suspect. Yes, you can get a co-sponsor.
 
He has been in jail most of the past 3 years and has been working a regular job for the past 5 months. Thats why he doesnt have a tax return and for 2008 he probably wouldnt even have to file as his income would be too low.

we will definitely need a sponsor. the question is it USCIS will accept an ex-inmate or if that will raise extra questions..
 
His criminal record will not disqualify him from petitioning for you as I know someone who had a long rap sheet and he successfully filed for his spouse. Do you work or have any income or pay taxes? If so, did you file a tax return?
 
My annual income is at 53k but I'm not on the US payroll of my employer. My paychecks are processed overseas. I am currently filing a taxreturn for 2008 and will also file one for 2007. I just found out that I have to file in the first place.. I thought I wasnt required to file taxes in the US as I'm paying taxes on my salary overseas.

thank you for your input but please keep the personal notes to yourself. After all you dont know me or my boyfriend.. I'll decide if he's a catch or not.

On the other hand it would be helpful if you shared the type of convictions that will exclude him from being able to sponsor me.

Generally, crimes of violence. What was he convicted of?

And yes, if you meet SPT you are a tax resident and need to file a tax return.
 
there is a violent crime 10 years ago but the recent charge (within past 3 years) which he was incarcerated for is drug-related.
