GC Processing-- Future Employment

Hi All

I have BS + 2year ( India experience) + 2 years ( US experience with my present employer)

I want to leave my present employer and join one of the bigger firms. My present employer wants to start my GC processing so that I may come back and work for them after my GC is done.

Should I start my GC processing with my present employer, leave them and again come back when I Get my GC ?

Can it have any major future implications ? Please help .
 
The only thing you have to ensure is that after you get your GC from the present employer, you join him for at least 6 months. You can leave him now and maybe the bigger firm that you join ends up processing your GC even faster.

Actually I am a big skeptical about my future employer. I have heard that if I am fro bench for than 2 months they revokes the H1 and cancels the GC processing.

So I was thinking the other way round.

If my PERM application gets rejected ( touch wood) from the smaller firm ( my present employer), then will there be any problems in applying for PERM through another company ?
 
Nope. There will be no problems. You may run into issues with the smaller firm at the I140 stage if te smaller firm is not financially sound.
 
Joining company

Hello newbies, great guru and creative10!!

My future employment based labor was approved couple of weeks ago. Currently, I am working for another company and not sure at what stage
(140 or 485) I can join the company that processed my labor. Does joining at later stage create an problem for them or me, or have any future implications.

Any information is appreciated.

You can join at the stage of I 485.

How to track 140 application status?

I am not sure if this is the right place to post my question.

I am trying to find my 140 application status but lawyer has refused to share the Application Receipt Number. He claims that file number belongs to employer. Is he correct? If so, is there any other way to track it?

creative10, you mention that there could be problems with I-140 with the smaller company if it's not financially sound. What kind of problems are we talking here?

What should be considered when working with a smaller company? Any checklists?

Will there be problems at a later stage? Or is it I-140 only?

It would help if anybody can throw some light on the same.

The company that sponsors you needs to prove that they are going to be able to pay you the prevailing wage that they promised they will pay you. This comes in the form of submitting financial documents, or getting a letter from the CFO (if company is mid-size+). If the company can prove that without any problems, then you don't have to worry.

My personal opinion is that it should not matter whether (s)he discloses that information to you or not. It would probably be more beneficial for them since you would not be bothering them until the time of approval. Did you try to ask your employer for the info? If you ask kindly, you might get it...

He's correct. You need to obtain authorization from the employer or have the employer give the number to you directly. Many companies are extremely sensitive about the information. It's "normal," I'd say.

Hi All,

I have filed two GC applications. One in EB2 category, future employer based (priority date:APR 2004) 140 approved and other in EB3 category (priority date: Dec 2006) labour approved with current employer.

Can I apply a new 140 with my current employer?

I would really appreciate if someone can tell my options here with retrogression in mind.

Yes , you can apply I 140 if it is approved you can use your APR 2004 priority date to adjust your status (I 485).

I would really appreciate if someone can tell my options here with retrogression in mind.
