I have a friend who has a green card now after 10 odd years.
His wife who had also moved to the US about 5 years ago is working on a H1.
Since the person in question now has a green Card , Can he file for I485 for his wife.
His wife wants to stay at home and be a full time MOM and if she quits the JOb she loses the H1 and her Status.
My question is if he files for her Green Card , ( Can he do that ???) how long will his wife needs to maintain her H1 status.
Will she get a EAD right away . what will be her status. will the retogression thing affect her. They dont mind waiting for the GC as long she and her daughter who by the way is under 21 ( barely ) be able to stay in the US legally. They have been legal all this while and they dont want to spoil that record.
Gurus please advise as one of lawyers told her no. which looks to me a Dumb answer.
Thanks

Spouse of GC holder has to wait for 5, 6 years to get GC. He needs to file I130.. And then once PD becomes current, she can file I485, but it's 5 - 6 year away. She needs to maintain her status(H1 is most likely due toimmigration intent) til I485 is filed.
EAD can be filed after I485 is filed, so she can not get EAD right away.

Al_aos,
but if he become a USC & then file for her GC, then process will go much faster and smoother and she will not have to maintain her status.
