GC - I485 Approval Pending for 2 years...

I am a current GC holder and my application ( Primary applicant ) was approved on Dec 2004. At that time, there was a RFE in my wife's application and hence her processing was delayed and then put in retrogression. Her application was later transferred to TEXAS service center and finally she received the approval letter of I-485 during last june ( June2007 ).

The letter said that her I485 petition is approved and at that moment she does not have to take any action and will receive further instructions for finger printing etc. We did wait and finally received a notice for FP. We waited hopefully to get her GC and we didnt receive any further notice from USCIS. During this time my wife's EAD expired and she got a temporary stamping for 2 months on her Passport from LOCAL uscis office ( DETROIT ) authorsing to work in US.

When we contacted the central TEXAS USCIS center, the representatvie said that my wifes status is still pending and NOT APPROVED. We informed her that we had received a letter of her approval and she said that her system doesnt not reflect this information.

Again my wife went to local USCIS office as her temporary stamping has again expired and she explained about her status to the local USCIS officer and he said that he will put a request to inquire the case. Months passed by and my wife hasnt received her GC yet.

The mental agony caused by this issue is beyond description. Please advise us how to resolve this GC issue.

She should contact your congressman/senator local office and provide full details of the case.

What would be the next course of action ?

Hi, what do you mean exactly by "central TEXAS USCIS center"? Did you call USCIS Customer Service, or were able to call the TSC directly? If that was Customer Service, this is rarely helpful. It may help if you go to infopass locally again, and depending on who you speak to, they may be able to call TSC directly and ask them about the case.

I dont know the full case details .If your wife file was sent to Local USCIS office for interview from service center and she was approved by local office after interview and the officer in local office took her index fingerprint and her signature on white form then her file was supposed to be sent back to service center (takes 20-30 days) to reach service center and then service center update the records in system and photographs and white form is sent to Card production unit and then card production unit send the card. Sometime the local office don’t send the file and sometime the file reach the service center and they don’t send to card production unit and forget to update the USCIS computer system. If her case was approved by service center then the officer who approved the case when on leave and file may be on some rack and somebody need to pull the file from rack and then update the system and send info to card production unit.


Do the below:
1. Again try to contact congressman/senator local office.
2 take the infopass and go to local USCIS office and talk to Supervisor and Supervisor may be able to locate her file ( they can locate the file with I-485 reciept # and A#)

Hi Ginnu,

Really appreciate your responses towards my case. As a brief history, I initially filed for VSC as I live in Detroit and got my GC. However for no specific reason, my wife's case got transferred to TSC even though we dont live in Texas or ever lived there.

The approval notice came from USCIS and NOT from local Detroit service center. We went to local service center to give the finger printing only. We have couple of times requested the local service center supervisor to inquire on our case with the USCIS and they have placed the queries twice but no responses from USCIS.

The bigger issue is, the USCIS database reflects my case status as Pending ( it went back to old status ) and doesnt have any history as approved. The only proof for the approval is the letter I received from USCIS.

I will try to contact local senator again and also try the CIS OMBUDSMAN link that you provided.
