GC for Parents

Hi

I am a US citizen (over 21) and planning to file 130+ 485 for my parents (currently in the US). From what I understand , I need to send 2 sets of application forms for each parent

Set 1 - i130 + g1145
Set 2 - i485+ i693+ I1864 + 325A + Copy of i130+ i131 +g1145

Both sets need to be sent together to

Copy of I-130, I-131, g1145 is not required of you submit everything together. Only one G1145 is required - attached to the top of the application package.
Make sure that you have supporting documents (Proof of your US citizenship, your birth certificate showing parents's names, parents' birth certificates, affidavits and secondary evidence if necessary, etc.)

1. Yes, I will be getting the required supporting documents. So will there be only 1 packet/per person with all the above original documents attached (i130 + g1145 + i485+ i693+ I1864 + 325A + i131 )

2. On G325A, section Applicant's residence last five years...I assume that since this is "residence", I do not have to list their addresses for the 2-3 trips that they made to the US during this 5 year term. They never overstayed and such visit's should not be mentioned as residence

1. One packet per person (fee check and G-1145 on top, include separate checks for I-130 and I-485).
2. Just their current (and previous, if any) residence, not places where they stayed while visiting US.
If you also apply for EAD (I-765, no additional fees required) you can get a EAD+Advance Parole combo card with which your parents can apply for SSN without waiting for GC. Works as a good ID document for use in the US. I-765 needs 2 additional photos.
 
i am also going through the same process. does anyone know how long the green card process takes to be completed from the time the I-130 is submitted?

It took me 4 months from filing to receiving green card for my mother.

I am new to this forum so pardon my placing a new question in someone else's thread. I am US citizen sponsoring my parents who are in the US to become Permanent residents. I have question on #16 on the I-30 form asking if relatives have been in immigration proceeding. My parents currently have withholding of removal status. I do not know how to select the available choices (removal, exclusion/deportation, rescission, or judicial proceeding). I suspect the latter would be the most suitable choice? Thank you very much for everyone's input and time!

Withholding of Removal (WOR) means they were Ordered Removed but could not qualify for asylum. Depending on if the reason for the removal order they may be inadmissible as immigrants. IF the basis for removal can be waived, they must actually qualify for a waiver.

They were in Removal Proceedings and now have WOR status.

2) i131 - Part 1 (Question 3) - What is the class of admission - They are on visitor visa (B1/B2)
3) i130 - Part C - Question (2) for the address. This is on the first page of the form itself and asks for an address. Is is the US address where they will stay or their native home address

Thank you BigJoe5 for the info. It's a bit discouraging to hear that there is an obstacle in sponsoring my parents. At my parents' hearing, the judge did mention that I can sponsor them however I am not sure if the piece of paper that my parents' receive at the hearing specifically reflects the judge's mention. In any case, I should do more research.

Sorry to belabor the I-30 question #16, but in this case, what should I put on the form? Judicial proceeding? Thanks a lot again!

What part of "REMOVAL PROCEEDING" did you not understand?

Sorry... got you mixed up with the one who invaded this thread.

Advance Parole is all one can get at this stage of the process. The new EAD/AP Combo card will not be mailed abroad.

B2 is the tourist half of that visa.

I for one will not look up the form but you have to be in the U.S. to file so you better have a U.S. address to get the card sent to.

Please review the id of the person who mentioned the WOR issue beforing jumping the gun. I (indeedgc) do NOT have a WOR issue.

So please let me know if you can help with the few basic questions

I apologize for invading this thread. I was not able to post new thread earlier and saw a thread with topic closely related to my interest.


I was informed by the attorney representing my parents at that time that they were not in removal proceeding hence my question asking clarification. It may seem very clear to that I should have selected "removal" and maybe it is the case...I just wish my follow up question would not create such hostility. To indeedgc, again I am sorry for possibly taking away attention from your question. Thanks again anyway.

The alien applicant will end up getting an EAD (Employment Authorization Document in category (c)(9) as a person with a pending adjustment application) as a result of the I-765. The new EAD will be annotated something like "serves as I-512". I-512 is the form number for an approved Advance Parole issue pursuant to the I-131.

I am still not looking up the form, but the adjustment code that will end up on the greencard of the parent of a USC is IR0 while the admission code on the card for a parent who enters on an actual Immigrant Visa will be IR5.
